Flashy recognizes and respects the importance of protecting the privacy of all information provided by Users. Flashy controls and processes information about its Users, and processes information about its Users' Clients. In order to better understand what kind of information we collect, and the way we process and use such information, please read carefully our Privacy Policy below before using our Services.

- Unless stated otherwise, the terms used in this Privacy Policy refer to the terms and their meanings as defined in the Terms of Use.

- When purchasing our Services, you may be required to provide payment and billing information, such as Your credit card details and billing address ("Payment Information"), however, while transactions can be performed through Flashy Website, we do not collect nor process Your Payment Information, but we direct You to a third party payments service provider, such as Stripe, who collects and processes Your Payment Information in order to complete the transaction with Us.
- We may collect from Your Clients for the following information:
- As part of Your use of the Services, you may provide us Personal Information and other information about Your Clients, such as their names, email addresses and telephone numbers. You can provide this information by uploading it to the Platform in bulk as a contacts list, importing it as a contacts list from a different compatible service, or entering manually each of your Clients' Personal Information into the Platform.
- As part of our Mailing Tool and Text Messaging Tool, we also collect data from Your Clients pertaining to actions they have taken in respect to messages You have sent them using our Services, such as whether a Client has opened your message, whether and which links in your message did a Client click on, whether a Client has marked Your message as spam or whether a Client has requested to unsubscribe from Your messages.
- If you implement any of our Features in Your Website, such as implementing Flashy Code in Your Website in order to use the Automation Tool and/or the Pop-up Tool, we will also collect information about Your Clients' activity in Your Website, such as pages in Your Website visited by a Client, purchases in Your Website made by a Client and orders not completed by a Client in Your Website, as well as information about Your Clients' devices, such as IP address and browser ID. The Pop-up Tool may further allow us to collect Personal Information from Clients visiting Your Website, if such Clients decide to provide their Personal Information through the Pop-up Tool.
- How We Use Information
- We may use the Information we collect from You for the following purposes:
- Enable and enhance your access to the Services;
- Provide and improve our Services;
- Personalize the Services for you according to Your preferences and requirements;

- As our customer, we process Your Personal Information as a data controller, which means we determine the purposes for which Your Personal Information is being processed. The processing of Your Personal Information is based on our legitimate interests, insofar these interests are not overridden by Your data protection interests or fundamental rights and freedoms. - We also process Your Clients' Personal Information as a data processor, which means we process Your Clients' Personal Information on behalf of You, the data controller of Your Clients' Personal Information. - When registering to our Services, you are required to choose your own password and username, which will allow you to securely access Your dashboard and Your data stored in our Services and use our Services. We are not exposed to Your password, and therefore cannot provide you with your password in case you forgot it, but only instruct you how to reset your password. - We may use various tracking technologies and techniques, such as Cookies and Web Beacons, to allow us to automatically collect Personal Information from You and Your Clients when using our Services in order to provide and improve Our Services.

- Web Beacons are elements included in emails You are sending using Our Mailing Tool and other Services. They are used to track Your Clients' interaction with the emails you are sending, and specifically to track whether an email was opened or marked as spam, whether a Client has unsubscribed from your emails, and whether links within an email were clicked. This information may be used to provide You insights and statistics concerning Your use of our Services and Your Clients' engagement with Your messages.
- International Transfers
- We operate in Israel and our servers are located in the EU (Germany), wherein Your Personal Information is stored and processed in accordance with this Privacy Policy.
- We may store and process Your and Your Clients' Personal Information in any country in the EU in which we may operate or have facilities, however, such storing and processing will be in accordance with this Privacy Policy in any case. By using the Services You acknowledge and allow us to internationally transfer Your and Your Clients' Personal Information.
